Gripster Warranty THIS IS TO CERTIFY that Banshee Outdoor Products. “The Gripster™”; is hereby registered to the original purchaser of such product, and is warranted to be free of all defects in material and workmanship for one year from the date of purchase. This warranty does not apply to any defects cause by negligence, misuse or accidents, or to any use not described in the instruction manual supplied with “The “The Gripster™”. This warranty expressly does not extend to the use of “The Gripster™” as a permanent mooring device, or use of “The Gripster™” as a towing device. Under no circumstances should “The Gripster™” be used as a permanent mooring device or a towing device. “The Gripster™” is designed as a temporary mooring device. Under varying weather and water conditions, the vacuum capability of “The Gripster™” to hold different size boats will change, and it is the responsibility of each “The Gripster™” user to determine the length of time that “The Gripster™” will properly hold and moor your particular boat. “The Gripster™” is designed to be used with either gel coat finishes or high quality paint that is clear coated with a hardened finish. The vacuum cups of “The Gripster™” may leave marks in a low quality finish on some older boats. It is up to the purchaser to try this product on an area of their boat that they are not concerned about to confirm that “The Gripster™”will not damage the finish on their boat and/or any boat they may be connecting to. This warranty expressly does not extend to the use of “The Gripster™” on connection points of boats that are not smooth and defect-free. Use of “The Gripster™” on any other area will decrease it’s holding ability and may possibly damage “The Gripster™” Within the period of the warranty, Banshee Outdoor Products, A California Corporation, will repair or replace, at our service center located in Sacramento, California, any part proving to be defective in material or workmanship. All expenses related to replacing or repairing a defective part under the warranty will be assumed by Banshee Outdoor Products, except for the following expenses which will be assumed by the buyer: The cost of shipping or transporting the product to Banshee Outdoor Products. Service center located at the address below. The buyer must notify Banshee Outdoor Products of any defect, malfunction or nonconformity promptly upon discovery and ship “The Gripster™” to Banshee Outdoor Products Service Center at the address below. Within fifteen(15) business days after receiving the notice and the product at our service center, Banshee Outdoor Products will repair or replace the defective part. Banshee Outdoor Products. will not be liable for any consequential or incidental damages. Banshee Outdoor Products. liability shall be limited to, and shall not exceed, the purchase price paid for “The Gripster™” We reserve the right to make changes or improvements in our products without incurring any obligation to similarly alter products previously purchased. The buyer has the right to bring any action at law or equity to resolve disputes concerning, or to enforce the provisions of the warranty. The buyer of this product in California has the right to
have this product serviced or repaired during the warranty period by Banshee
Outdoor Products. The warranty period will be extended for the number
of whole days that the product has been out of the buyer’s hands
for warranty repairs. If a defect exists within the warranty period, the
warranty repairs have not been performed due to delays caused by circumstances
beyond the control of the buyer, or if the warranty repairs did not remedy
the defect and the buyer notifies the manufacturer or seller of the failure
of the repairs within sixty (60) days after they were completed. If, after
a reasonable number of attempts, the defect has not been fixed, the buyer
may return this product for a replacement or a refund subject,. in either
case, to deduction of a reasonable change for usage. This time extension
does not affect protections or remedies the buyer has under other laws. |
